Judge Schedules Bond Review for Defendant

A judge scheduled a bond review hearing for one defendant in a co-defendant case.

Donnell Jones is charged with assault with a dangerous weapon. Jones was also charged with unlawful possession of a firearm with a prior conviction, but the prosecution dropped the charge.

Jones’ attorney, Evan Parke, told DC Superior Court Judge Juliet McKenna that he believed his client is eligible for release under the High Intensity Supervision Program (HISP).

Jones, who is being held without bail, has been denied release twice because he was on probation for another gun conviction when arrested and because the charges were for a violent and dangerous crime.

However, Parke said, in a motion for release, that there is no evidence tying Jones to the assault with a dangerous weapon charge. The motion says there is evidence of a witness, a Metropolitan Police Department detective, saying that Jones was not the person he saw brandish and fire a gun.The detective said that Fleming was the person he saw pull a firearm and start shooting at a crowd of unidentified victims.

Parke also said that video evidence that would have cleared his client was not retained by the police.

Judge McKenna decided May 27 to schedule a bond review hearing before DC Superior Court Judge Michael Ryan on June 2. The prosecution and defense agreed to the new hearing. If the bond motion is denied, a preliminary hearing will be set.

Jones’ co-defendant, Deandre Emon Fleming, is charged with assault with a dangerous weapon and carrying a piston without a license outside of a home or business. Fleming was released on March 25.
