The government will allow Davon Holmes to appeal his sentence.
Holmes was sentenced to 24 years on Oct. 18, 2013 after a jury trial found him guilty in 2013 of second-degree murder while armed.
Holmes, of Northwest, was arrested on Sept. 9, 2011 and plead not guilty for the murder of Marcellus Terrell Bailey. The Metropolitan Police Department’s Homicide Branch found Bailey on the 5300 block of 8th Street, NW on Aug. 3, 2011. He was taken to a local hospital, where he was pronounced dead.
A status hearing is scheduled for Jan. 5, 2018.
