The defendant in an armed carjacking case filed a request for a reexamination of his release conditions, challenging his current confinement, before DC Superior Court Judge Errol Arthur on July 25.

Gregory Patterson, 41, and Jimmy Johnson, 43, are charged with armed carjacking and possession of a firearm during a crime of violence for their alleged involvement in an incident that occurred on the 1600 block of Kenilworth Avenue, NE, on July 11, 2023.

Patterson is also charged with armed robbery in connection to the incident.

At the hearing, Johnson’s defense attorney, Joseph McCoy requested Johnson be released, claiming a witness had testified under oath that Johnson was providing help at the scene of the incident, suggesting he was not actually a suspect.

The prosecution said that was not the case and that the witnesses had testified that Johnson “may” have been helping.

McCoy requested a reexamination of the grand jury transcripts.

DC Superior Court Judge Errol Arthur granted the request and gave the prosecution until Aug. 2 to respond to McCoy’s motion for release.

Trial is set for Sept. 30.
