DC Superior Court Judge Judith Smith denied a motion to re-sentence a man convicted of a felony.

Charles Wheeler is currently serving 18-months in prison after pleading guilty to attempt to commit robbery in 2019.

Wheeler filed the motion for reconsideration in light of the COVID-19 pandemic on May 4.

After the denied motion to re-sentence, Wheeler’s lawyer, Quiana Harris, motioned for compassionate release. The motion states that Wheeler suffers from epileptic seizures, severe depression and a tooth infection. The motion states that his medical needs have not been “adequately addressed” because of the pandemic.

Wheeler is scheduled for a post disposition hearing on June 2.
