DC Superior Court Judge Todd Edelman released a defendant under the high intensity supervision program (HISP) on April 29.
Patrick Roberts is charged with assault with the intent to kill while armed.
A preliminary hearing is scheduled for June 12.
Roberts filed an emergency motion for release on March 18.
